2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Service, you represent and warrant that you meet these eligibility requirements.

3. The Service

justRead.app is a reading application that allows you to read EPUB files and other supported formats. The Service includes features such as a customizable reading experience, reading statistics, and a feature voting system powered by VoteFirst.app.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

4. Your Account and Content

Your Content

You retain full ownership of any Content you upload or import into the Application. We do not access, read, analyze, share, or sell your Content. Your books and files are yours alone.

You are solely responsible for ensuring that you have the legal right to use any Content you import into the Application, including compliance with applicable copyright laws.

If the Service requires an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at support@justread.app if you suspect unauthorized access.

5. Subscriptions and Payments

5.1 Subscription Plans

Certain features of the Service require a paid Subscription. We offer monthly, annual, and occasionally lifetime Subscription plans. The applicable price will be displayed at the time of purchase and may vary by country and App Store location.

5.2 Billing and Renewal

All Subscriptions are purchased as In-App Purchases through the Apple App Store. Billing is handled entirely by Apple and is subject to Apple’s terms and conditions. Monthly and annual Subscriptions will automatically renew at the end of each billing period unless you cancel before the renewal date.

5.3 Cancellation

You may cancel your Subscription at any time through your Apple ID settings: Settings > [Your Name] > Subscriptions > justRead.app > Cancel Subscription. Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until that period ends. No partial refunds are provided for unused time within a billing period.

5.4 Price Changes

We may change Subscription prices from time to time. Any price change will take effect at the start of the next billing period following notice of the change. Apple will notify you of price increases in advance as required by App Store policies. Your continued use of the Service after a price change constitutes acceptance of the new price.

5.5 Refunds

Since all purchases are processed through the Apple App Store, refund requests are handled by Apple in accordance with their refund policy. To request a refund, please contact Apple Support directly through the App Store or at reportaproblem.apple.com.

We may also consider refund requests on a case-by-case basis at our discretion. Contact us at support@justread.app if you have billing concerns.

6. Free Trial

We may offer a free trial period of 7 days for new users. You may need to provide payment information to start the free trial.

If you do not cancel your Subscription before the free trial ends, you will automatically be charged the applicable Subscription fee. You may cancel at any time during the trial through your Apple ID Subscription settings at no cost.

The Service integrates with or links to certain third-party services:

The Service may also contain links to other third-party websites or services. We are not responsible for the content, privacy practices, or availability of third-party services and assume no liability for any harm arising from your use of them.

11. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that it will meet your specific requirements or expectations. We do not warrant the accuracy, completeness, or reliability of any content available through the Service.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the amount you have actually paid us through the Service in the 12 months preceding the claim, or 100 USD, whichever is greater.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of Content, business interruption, or personal injury arising from your use of or inability to use the Service.

Important: Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In those jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Termination

Termination by You

You may stop using the Service and delete the Application at any time. If you have an active Subscription, please cancel it through your Apple ID settings before deleting the app to avoid continued billing.

Termination by Us

We may suspend or terminate your access to the Service immediately and without prior notice if you materially breach these Terms, including violations of the Acceptable Use policy. We may also discontinue the Service entirely at our discretion, in which case we will make reasonable efforts to provide advance notice.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will continue to apply.

14. Rights for European Union Consumers

If you are a consumer located in the European Economic Area (EEA), the United Kingdom, or Switzerland, the following provisions apply to you in addition to (and where they conflict, take precedence over) the rest of these Terms:

Mandatory Consumer Protections

Nothing in these Terms shall limit or exclude any rights you have under mandatory consumer protection laws in your country of residence, including Directive 2011/83/EU on consumer rights. Where these Terms conflict with such mandatory provisions, your local consumer rights prevail.

Right of Withdrawal

Under EU consumer law, you have the right to withdraw from a digital content purchase within 14 days of the transaction without giving any reason. However, by initiating a download or starting to use the digital content (including starting a Subscription or free trial), you acknowledge that you lose your right of withdrawal once the digital content has been fully provided, in accordance with Article 16(m) of Directive 2011/83/EU.

For In-App Purchases made through the Apple App Store, the withdrawal process is governed by Apple’s policies. You may request a refund through Apple at reportaproblem.apple.com.

Conformity Guarantee

Under EU law (Directive (EU) 2019/770), digital content and services must conform with what was agreed in the contract. If the Service does not conform, you are entitled to have the Service brought into conformity free of charge, or to receive an appropriate price reduction, or to terminate the contract under the conditions set out in applicable law.

Online Dispute Resolution

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board, but we are committed to resolving disputes directly with you. Please contact us first at support@justread.app.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

If you are a consumer in the EEA, you may also benefit from mandatory provisions of the law of your country of residence, and nothing in this section deprives you of the protection afforded by those provisions.

In the event of any dispute arising from these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at support@justread.app. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the competent courts.

United States Compliance

If you access the Service from the United States, you represent and warrant that you are not located in a country subject to a U.S. government embargo and that you are not listed on any U.S. government list of prohibited or restricted parties.

16. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Translation

These Terms may be available in multiple languages. In the event of a conflict between translations, the English language version shall prevail.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. This notice may be provided via email, through the Application, or on the website.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, please stop using the Service.
